This Takedown and Appeals Policy explains how users and other affected persons may report content, request removal of content, appeal certain decisions, or ask After Dark Society, LLC to review content appearing on AfterDarkSociety.com, the AfterDark Society mobile applications, or any related platform operated by After Dark Society, LLC.
In this policy, we refer to those services collectively as the “Platform.” The Platform is operated by After Dark Society, LLC (“After Dark Society,” “we,” “us,” or “our”).
This policy is part of our Terms of Service and applies in addition to our Community Guidelines, Privacy Policy, 18 U.S.C. §§ 2257–2257A Record-Keeping Compliance Statement, DMCA and Copyright Policy, Child Safety Standards, Anti-Trafficking and Exploitation Policy, and other applicable Platform policies.
This policy is intended to provide a clear process for:

To help us review your request, include as much of the following information as you can:
Do not submit government ID, sensitive documents, or private images unless we request them through a secure process or unless they are necessary to explain your request.
If you believe a person is in immediate danger, contact emergency services first.
If you believe content involves child sexual abuse material, sexual exploitation of a minor, trafficking, imminent harm, coercion, or a serious threat to safety, report it immediately through the Platform reporting tools or by contacting support@afterdarksociety.com.
We may remove or restrict content, preserve records, suspend accounts, report to NCMEC, report to law enforcement, notify regulators or payment processors, or take other action required or permitted by law.
If you are depicted in content on the Platform, you may request review or removal if you believe that:
We may remove or restrict content while we review your request.
If consent cannot be established, or if you demonstrate that consent is invalid or void under applicable law, we will remove the content as required by law and our policies.
You may report nonconsensual intimate content appearing on the Platform.
Nonconsensual intimate content includes nude, sexual, explicit, intimate, or sexually suggestive photos, videos, images, or other visual depictions of a person that were posted, shared, distributed, or made available without that person’s consent.
Nonconsensual intimate content may include authentic content, AI-generated content, digitally altered content, manipulated content, deepfake content, face-swapped content, or synthetic content.
To submit a nonconsensual intimate content request, provide:
When we receive a valid request involving nonconsensual intimate content, we will remove or disable access to the reported content and known identical copies as required by applicable law.
Content involving minors in any sexual, nude, intimate, exploitative, abusive, or suggestive context is prohibited.
If we believe content involves or may involve a minor, we may remove or restrict the content immediately, suspend or terminate accounts, preserve records, report to NCMEC, notify law enforcement, and take other action required or permitted by law.
A person who was under 18 when content was created may request removal even if that person is now an adult.
You may report content, messages, profiles, groups, events, or conduct involving trafficking, coercion, exploitation, prostitution, escorting, illegal sexual services, forced sexual activity, sextortion, blackmail, threats, or other illegal sexual activity.
We may remove or restrict content, disable accounts, preserve records, notify law enforcement, notify payment processors, notify app stores, or take other action required or permitted by law.
Copyright complaints must be submitted under our DMCA and Copyright Policy.
If your complaint involves both copyright infringement and nonconsensual intimate content, you may submit both a DMCA notice and a request under this policy.
We may process the request under the policy or procedure that best fits the issue.
After we receive a takedown request, complaint, or report, we may:
We try to review complaints and takedown requests promptly.
All reported complaints and takedown requests will be reviewed and resolved within five business days of receipt. We will tell the person who reported the content the outcome of the review.
For valid nonconsensual intimate content requests subject to a shorter legal deadline, we will remove or disable access to the reported content and known identical copies within the time required by applicable law.
For urgent child-safety, trafficking, coercion, imminent-harm, or emergency matters, we may act more quickly.
Where appropriate and permitted by law, we may notify the uploader or affected account holder that content has been reported, removed, restricted, or disabled.
We may give the uploader or affected account holder an opportunity to respond, provide consent documentation, provide age or identity records, provide context, or appeal.
We may withhold notice or delay notice if we believe notice would create a safety risk, facilitate retaliation, interfere with an investigation, violate law, expose a person to further harm, reveal sensitive reporting information, or undermine Platform integrity.
A person depicted in content may appeal a decision not to remove content if that person believes:
To appeal, contact support@afterdarksociety.com and identify the content, the original request, the decision being appealed, and the reason for appeal.
If we remove, restrict, disable, or take enforcement action against content or an account, the uploader or account holder may appeal. Send the appeal to support@afterdarksociety.com or use the Platform reporting tools.
An appeal should include:
We may deny appeals that are incomplete, abusive, fraudulent, repetitive, submitted in bad faith, or unsupported.
We may also deny appeals where restoration would violate law, create a safety risk, violate payment-processor rules, violate card-network rules, violate app-store rules, violate a depicted person’s rights, or violate our policies.
If there is a dispute about whether a depicted person consented to content, we may require evidence of consent.
Evidence may include written consent forms, electronic releases, identity verification records, performer records, communications, upload records, metadata, or other documentation.
If the uploader cannot establish valid consent, or if the depicted person demonstrates that consent is invalid or void under applicable law, we may remove the content.
If a disagreement cannot be resolved internally, we will allow the disagreement to be resolved by a neutral third-party body, at After Dark Society’s expense.
If there is a disagreement regarding an appeal, we will allow the disagreement to be resolved by a neutral third-party body, at After Dark Society’s expense. This also applies to a dispute concerning consent, depicted-person rights, or removal.
The neutral reviewer may consider the information submitted by the depicted person, the uploader, and After Dark Society.
After Dark Society may remove or restrict the content while neutral review is pending.
You must not submit false, misleading, abusive, fraudulent, or bad-faith reports, takedown requests, complaints, or appeals.
You must not use this policy to harass another person, suppress lawful speech in bad faith, retaliate against another user, interfere with another person’s account, or make false claims of nonconsent, infringement, impersonation, abuse, or illegality.
We may deny abusive requests and may restrict or terminate accounts that misuse reporting, takedown, complaint, or appeal processes.
We may restrict, suspend, or terminate users who repeatedly or seriously violate the Terms of Service, Community Guidelines, this policy, or other Platform policies.
We may also restrict, suspend, or terminate users who repeatedly upload content without valid consent, upload content involving minors, submit false records, engage in trafficking or exploitation, post nonconsensual intimate content, or abuse the takedown or appeal process.
This policy does not replace the Terms of Service, Community Guidelines, Privacy Policy, DMCA and Copyright Policy, Child Safety Standards, Anti-Trafficking and Exploitation Policy, or other Platform policies.
If a request involves multiple issues, we may process it under one or more applicable policies.
If a law provides a right or procedure that cannot be waived, that law controls.
We may update this policy from time to time.
When we make material changes, we may notify users by posting the updated policy, updating the “Last updated” date, sending an email, providing an in-platform notice, using a click-through notice, or using another method reasonably designed to notify affected users.
Your continued use of the Platform after updated policy becomes effective means you acknowledge the updated policy.
