These Referral Program Terms govern the AfterDark Society referral program. The referral program allows eligible users to invite other eligible adults to join AfterDarkSociety.com, the AfterDark Society mobile applications, and any related websites, applications, communities, messaging tools, features, and services that link to these Referral Program Terms. In these Referral Program Terms, we refer to those services collectively as the “Platform.”
The Platform and referral program are operated by After Dark Society, LLC (“After Dark Society,” “we,” “us,” or “our”).
These Referral Program Terms are part of our Terms of Service and apply in addition to our Privacy Policy, Community Guidelines, Subscription, Billing, Cancellation, and Refund Policy, Affiliate Program Terms, and other applicable Platform policies.
By participating in the referral program, sending a referral link, using a referral link, accepting a referral reward, or claiming a referral benefit, you agree to these Referral Program Terms.
The referral program allows eligible users to invite eligible adults to join the Platform.
If a referred person uses an approved referral link, registers for the Platform, completes required verification steps, and satisfies all referral requirements, the referring user may receive a referral reward.
Referral rewards may include free subscription time, subscription upgrades, account credits, badges, visibility benefits, or other benefits we make available.
The Platform is for adults only.
You must not invite, refer, target, solicit, or encourage any person under 18 to join or use the Platform.
You must not send referral links to minors or to audiences, communities, groups, events, websites, platforms, publications, or channels primarily directed to minors.
If we determine that a referral involves a minor, suspected minor, false age information, or attempted circumvention of age verification, we may deny or revoke the referral reward, restrict accounts, terminate accounts, preserve records, and take any other action required or permitted by law or Platform policy.

We may provide eligible users with referral links, referral codes, invite tools, QR codes, share tools, or other referral methods.
You may use only referral methods approved by us.
You must not modify, manipulate, obscure, sell, trade, post deceptively, or misuse referral links or referral codes.
We may modify, replace, suspend, or disable referral links, codes, and invite tools at any time for operational, compliance, fraud-prevention, safety, attribution, or product reasons.
A referral qualifies for a reward only if all of the following conditions are satisfied:

A referral does not qualify for a reward if:
Our records control referral attribution unless we determine that a material tracking error occurred.
Referral rewards may vary by user, location, promotion, subscription plan, eligibility, referral source, product feature, purchase channel, or time period.
Unless we state otherwise, a referral reward has no cash value, is not redeemable for cash, is not transferable, and may be used only on the Platform.
Referral rewards may expire, be limited to specific features, be subject to usage limits, or be unavailable in certain jurisdictions or purchase channels.
We may change, substitute, suspend, revoke, or discontinue referral rewards at any time, subject to applicable law.
If we offer free subscription time as a referral reward, the free subscription time applies only to the eligible subscription plan, account, and period stated in the referral offer.
For example, if the referral program offers free Velvet subscription days for a qualified referral, the reward applies only as stated in the offer and does not entitle you to cash, refunds, credits, plan conversion, or other benefits unless we expressly state otherwise.
Free subscription time may not pause, replace, extend, or modify a subscription purchased through CCBill, Apple, Google, or another payment provider unless our systems and the applicable provider permit that result.
If you have an active paid subscription, the referral reward may be applied as account credit, free time, subscription extension, promotional access, or another benefit determined by us and the applicable payment provider.
The referral program may include account-connection features.
For example, a referred user may automatically follow, connect with, or be suggested to the referring user after joining, depending on the referral flow, user settings, and Platform features.
By using a referral link or referral code, the referred user acknowledges that the referring user may know or be able to infer that the referred user registered, joined, verified, followed, connected, or otherwise interacted with the Platform through that referral.
Users should not use referral links if they do not want the referring user to know or infer that they joined the Platform.
Referral rewards may require the referred user to complete verification steps, including email verification, age verification, identity verification, or other checks.
A referral is not qualified merely because the referred user clicks a referral link or creates an account.
If the referred user does not complete required verification, submits false information, fails verification, is identified as a duplicate account, or is otherwise ineligible, no reward will be issued.
You must not manipulate or abuse the referral program.

We may deny, suspend, reverse, or revoke referral rewards if we suspect fraud, manipulation, abuse, or violation of these Referral Program Terms.
If you share referral links publicly, you must do so lawfully and accurately.

If you receive or may receive a referral reward for inviting someone to the Platform, you must disclose that connection when required by law.
Any disclosure must be clear, conspicuous, understandable, and placed where people will notice it before or when they use your referral link.
Examples may include:
You are responsible for complying with advertising, endorsement, consumer-protection, anti-spam, privacy, and other laws that apply to your referral activity.
You must not use spam or unwanted communications to promote referral links.
You must not send referral links by email, text message, direct message, phone call, social message, push notification, or other communication unless you have any required consent and the communication complies with applicable law and platform rules.
You must honor unsubscribe, stop, block, opt-out, and do-not-contact requests.
Referral rewards may have tax consequences.
You are responsible for any taxes, reporting obligations, or other obligations arising from referral rewards.
We may require tax, identity, payment, or other information before issuing certain rewards.
We may withhold, deny, or revoke rewards if required information is missing or if required by law.
Referral rewards may not be issued immediately.
We may delay issuing a reward while we verify the referred user, review fraud signals, confirm eligibility, evaluate duplicate-account risk, review compliance issues, or complete other operational checks.
We may revoke or reverse a reward after issuance if we later determine that the referral did not qualify.
We may modify, suspend, or terminate the referral program at any time.
We may change eligibility criteria, referral rewards, reward timing, verification requirements, attribution rules, program features, limits, referral methods, or these Referral Program Terms.
If we make material changes, we may provide notice by posting updated terms, sending an email, providing an in-platform notice, updating the referral dashboard or referral page, or using another reasonable method.
Your continued participation in the referral program after changes become effective means you acknowledge the updated terms.
If your account is suspended, restricted, or terminated, you may lose access to referral links, referral rewards, pending rewards, issued rewards, referral history, or referral program features.
If we determine that you violated these Referral Program Terms, the Terms of Service, Community Guidelines, or other Platform policies, we may deny, revoke, reverse, or cancel referral rewards.
Participation in the referral program does not guarantee that you will receive any reward.
A referral link click, account creation, invitation, follow, message, or signup does not guarantee reward eligibility.
Rewards are issued only if all requirements are satisfied and the referral is approved in our records.
The referral program is intended for ordinary user referrals.
The Affiliate Program Terms apply to approved affiliates, commercial promoters, marketers, influencers, publishers, media buyers, or other persons participating in the formal affiliate program.
We may determine that a user’s referral activity is commercial or promotional activity that must be handled through the affiliate program rather than the referral program.
We may deny referral rewards if referral activity should have been conducted through the affiliate program or violates affiliate-program requirements.
To the extent permitted by law, After Dark Society will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising out of or relating to the referral program.
To the extent permitted by law, After Dark Society’s total liability arising out of or relating to the referral program will not exceed the value of referral rewards actually issued to you during the three months before the event giving rise to the claim.
Florida law governs these Referral Program Terms and all disputes arising out of or relating to the referral program, without regard to conflict-of-law rules.
Any dispute arising out of or relating to these Referral Program Terms or the referral program must be resolved under the dispute-resolution provisions in the Terms of Service, unless we have entered into a separate signed agreement with you that provides otherwise.
