This Nonconsensual Intimate Content Policy explains how After Dark Society, LLC handles reports and removal requests involving nonconsensual intimate images, videos, and similar visual depictions.
This policy applies to AfterDarkSociety.com, the AfterDark Society mobile applications, and any related websites, applications, communities, messaging tools, features, and services that link to this policy. In this policy, we refer to those services collectively as the “Platform.”
The Platform is operated by After Dark Society, LLC (“After Dark Society,” “we,” “us,” or “our”).
The Platform is an adult-only platform. Nonconsensual intimate content is prohibited.
This policy is part of our Terms of Service and applies in addition to our Community Guidelines, Takedown and Appeals Policy, Privacy Policy, 18 U.S.C. §§ 2257–2257A Record-Keeping Compliance Statement, DMCA and Copyright Policy, Child Safety Standards, Anti-Trafficking and Exploitation Policy, and any other policy that applies to your use of the Platform.
This policy applies to intimate visual depictions that are uploaded, posted, sent, displayed, stored, shared, distributed, or otherwise made available through the Platform without the consent of the identifiable person depicted.
This includes authentic, photographed, recorded, edited, manipulated, digitally altered, AI-generated, synthetic, deepfake, face-swapped, or similar visual depictions.
This policy applies whether the content appears in a post, profile, photo, video, story, comment, private message, group, event, link, thumbnail, preview, screenshot, or other Platform feature.
You must not upload, post, send, request, solicit, threaten, share, distribute, display, store, link to, or otherwise make available nonconsensual intimate content.
You must not:
For purposes of this policy, intimate content includes a visual depiction that shows or appears to show:
This policy applies even if the content was originally created consensually, privately shared consensually, or publicly available elsewhere, if it was made available on the Platform without the depicted person’s consent.
A removal request may be submitted by:
We may request information reasonably needed to confirm that the requester is authorized to submit the request.
You may submit a removal request through the Platform’s reporting tools where available.
You may also submit a request by email to:
Your request should use the subject line:
Nonconsensual Intimate Content Removal Request
If your request involves immediate danger, a minor, trafficking, exploitation, threats, extortion, or blackmail, say so clearly in the request.
To help us review your request, include the following information:
You should include enough information for us to locate the content. If we cannot locate the content, we may ask for more information.
Do not send additional nude, sexual, explicit, or intimate images unless we specifically ask for them and provide a secure way to submit them.
When we receive a removal request, we will review it promptly.
If we receive a valid request involving nonconsensual intimate content, we will remove or disable access to the reported content as soon as possible and no later than 48 hours after receiving the valid request, unless a shorter deadline applies under applicable law.
We will also make reasonable efforts to identify and remove known identical copies of the reported content from the Platform, as required by applicable law.
We may remove or disable access to content before completing our review if we believe the content may be nonconsensual intimate content, may involve a minor, may involve trafficking or exploitation, may violate law, or may create serious safety, legal, or compliance risk.
A removal request may result in removal or disabling of access to known identical copies of the reported content on the Platform.
Known identical copies may include identical files, duplicate uploads, reposts, or copies that we can reasonably identify using available information, technical tools, reports, hashes, metadata, file comparison, visual review, or other reasonable methods.
We may not be able to identify every altered, cropped, edited, transformed, compressed, screen-recorded, watermarked, or materially changed version of the content. You may submit additional reports if you find additional copies.
Any nude, sexual, intimate, exploitative, or sexually suggestive content involving a person under 18 is prohibited.
If content depicts or appears to depict a minor in a sexual, nude, intimate, exploitative, or abusive context, we may remove or restrict the content immediately, preserve records, suspend or terminate accounts, report to NCMEC, contact law enforcement, and take other action required or permitted by law.
A person who was under 18 when content was created may request removal even if that person is now an adult.
Threatening to share, expose, publish, sell, distribute, or disclose intimate content without consent is prohibited.
This includes threats made in posts, private messages, profiles, groups, events, comments, off-platform links, or other communications connected to Platform use.
We may restrict or terminate accounts, preserve records, report to law enforcement, or take other action if we believe a user has threatened to disclose intimate content without consent.
Where appropriate and permitted by law, we may notify the uploader or affected account holder that content has been reported, removed, disabled, or restricted.
We may withhold notice or delay notice if we believe notice would create a safety risk, facilitate retaliation, expose the requester to further harm, interfere with an investigation, reveal sensitive reporting information, or undermine Platform enforcement.
If we permit the uploader to respond, the uploader must not contact, threaten, harass, retaliate against, dox, or intimidate the requester or depicted person.
A person whose content or account is restricted because of a nonconsensual intimate content report may appeal where we make an appeal available or where required by law.
An appeal must include:
We may deny an appeal if the appellant cannot establish that the depicted person consented to the content being made available on the Platform, if restoration would violate law, if restoration would create a safety risk, or if restoration would violate the Terms of Service, Community Guidelines, this policy, payment-processor rules, card-network rules, app-store rules, or other Platform requirements.
If there is a dispute about consent, we may require evidence showing that the depicted person consented to the content being uploaded, posted, sent, shared, distributed, or otherwise made available on the Platform.
Evidence may include written consent forms, electronic releases, identity-verification records, performer records, communications, upload records, metadata, or other documentation.
If the uploader cannot establish valid consent, or if the depicted person demonstrates that consent is invalid or void under applicable law, we may remove or continue to restrict the content.
You must not submit false, fraudulent, abusive, or bad-faith removal requests.
You must not use this policy to harass another person, suppress lawful content in bad faith, interfere with another user’s account, retaliate against another user, or knowingly make false claims.
We may deny abusive requests and may restrict or terminate accounts that misuse this process.
We may preserve content, account information, reports, communications, metadata, verification materials, and related records when we believe preservation is required or appropriate for legal compliance, safety, law enforcement, dispute resolution, moderation, anti-trafficking, child safety, fraud prevention, or platform integrity.
We may disclose information to law enforcement, NCMEC, regulators, courts, payment processors, card networks, app stores, legal advisors, or other appropriate entities where required or permitted by law or where we believe disclosure is necessary to address safety, child-safety, exploitation, trafficking, or legal concerns.
A nonconsensual intimate content request is separate from a copyright notice.
If you own the copyright in content, you may also submit a DMCA notice under our DMCA and Copyright Policy.
If a request involves both nonconsensual intimate content and copyright infringement, we may process the request under one or more applicable policies.
Violating this policy may result in enforcement action, including:
We may update this policy from time to time.
When we make material changes, we may notify users by posting the updated policy, updating the “Last updated” date, sending an email, providing an in-platform notice, using a click-through notice, or using another method reasonably designed to notify affected users.
Your continued use of the Platform after an updated policy becomes effective means you acknowledge the updated policy.
