EU Digital Services Act and Recommender Systems Statement

This EU Digital Services Act and Recommender Systems Statement explains how After Dark Society, LLC provides information and user controls relating to content moderation, reporting, complaints, appeals, recommender systems, and Platform transparency for users in the European Union.

This statement applies to AfterDarkSociety.com, the AfterDark Society mobile applications, and any related websites, applications, communities, messaging tools, features, and services that link to this statement. In this statement, we refer to those services collectively as the “Platform.”

The Platform is operated by After Dark Society, LLC (“After Dark Society,” “we,” “us,” or “our”).

This statement supplements our Terms of Service, Community Guidelines, Privacy Policy, Takedown and Appeals Policy, Complaints Policy, Nonconsensual Intimate Content Policy, Child Safety Standards, Anti-Trafficking and Exploitation Policy, DMCA and Copyright Policy, and other applicable Platform policies.

1. Purpose

This statement is intended to provide EU users with information about:

  • how users may report illegal content or policy-violating content;
  • how we review reports and complaints;
  • how users may appeal certain content-moderation decisions;
  • how recommender systems may influence content, profiles, groups, events, discovery, search, and other Platform features;
  • the main parameters used by recommender systems on the Platform;
  • options users may have to modify or influence recommender systems; and
  • how EU users may contact us about DSA-related matters.

3. Reporting Illegal Content or Policy Violations

Users may report content, profiles, messages, groups, events, comments, accounts, or other activity that they believe is illegal or violates Platform policy.

Reports may be submitted through Platform reporting tools where available.

A report should include enough information for us to locate and review the issue, such as:

  • the URL, username, profile, post, message, group, event, comment, screenshot, or other identifier;
  • a description of the issue;
  • the reason the user believes the content or conduct is illegal or violates Platform policy;
  • whether the issue involves minors, nonconsensual intimate content, trafficking, coercion, exploitation, threats, harassment, fraud, privacy, copyright, or another urgent concern;
  • any supporting information; and
  • the reporter’s contact information, if the reporter wants a response.

4. Our Review of Reports

After receiving a report, we may review the reported content, account, messages, metadata, user history, verification information, consent information, prior reports, and other relevant information.

We may use automated tools, human review, trust-and-safety personnel, vendors, legal review, or a combination of these methods.

Depending on the issue, we may:

  • take no action;
  • ask for more information;
  • remove content;
  • restrict content;
  • disable access to content;
  • add warnings, labels, or age-gates;
  • restrict features;
  • suspend or terminate an account;
  • require verification or consent documentation;
  • preserve records;
  • report to law enforcement, NCMEC, regulators, payment processors, card networks, app stores, or other appropriate entities;
  • process the matter under another Platform policy; or
  • take any other action required or permitted by law or Platform policy.

5. Content Moderation Decisions

We may moderate content or accounts if we determine that content or conduct violates law, the Terms of Service, Community Guidelines, this statement, or other Platform policies.

Moderation decisions may be based on:

  • user reports;
  • trusted or priority reports where applicable;
  • automated detection;
  • human review;
  • legal requirements;
  • child-safety concerns;
  • nonconsensual intimate content concerns;
  • anti-trafficking concerns;
  • payment-processor rules;
  • card-network rules;
  • app-store rules;
  • privacy or intellectual-property concerns;
  • safety risks;
  • fraud, spam, or security signals;
  • age or identity verification results;
  • consent or 2257-related issues; and
  • other information available to us.

6. Appeals

Users may appeal certain moderation decisions where we make an appeal process available or where required by law.

An appeal should include:

  • the account username;
  • the content, account, report, or decision being appealed;
  • the reason the user believes the decision was incorrect;
  • any supporting information; and
  • the outcome requested.

We may deny appeals that are incomplete, abusive, fraudulent, repetitive, submitted in bad faith, unsupported, or inconsistent with law or Platform policy.

7. Out-of-Court Dispute Resolution

If EU law gives a user the right to use a certified out-of-court dispute settlement body for certain content-moderation disputes, After Dark Society will cooperate with that process as required by applicable law.

Nothing in this section limits any rights or remedies that cannot be waived under applicable law.

8. Recommender Systems

The Platform may use recommender systems to help display, rank, prioritize, suggest, or personalize content, profiles, users, groups, events, messages, search results, discovery results, notifications, and other Platform features.

A recommender system is a system that suggests, ranks, or prioritizes information for users based on signals such as user activity, account settings, content information, location settings, user preferences, popularity, recency, safety signals, or other criteria.

Recommender systems are intended to help users find relevant content, users, groups, events, and Platform features.

9. Main Parameters Used by Recommender Systems

The main parameters that may influence recommendations, ranking, search, discovery, feeds, event suggestions, group suggestions, profile suggestions, and similar features include:

  • User activity. We may consider actions such as likes, sparks, follows, profile views, messages, comments, saves, RSVPs, group joins, event activity, searches, clicks, reports, hidden content, blocked users, muted users, and other Platform interactions.
  • Profile information. We may consider information users provide in their profiles, such as age range, approximate location, relationship status, single or couple account status, interests, tags, preferences, biography, photos, verification status, and similar profile information.
  • User settings and preferences. We may consider settings such as NSFW preferences, hidden content, keyword filters, close friends, blocked users, muted users, location settings, radius controls, email preferences, notification settings, and other user controls.
  • Location and proximity. Where enabled, we may consider approximate location, distance, radius settings, event location, group location, check-in information, and location privacy controls.
  • Content information. We may consider content type, tags, captions, text, media type, recency, engagement, comments, reactions, reports, moderation status, NSFW classification, and other content-level information.
  • Popularity and engagement. We may consider how users interact with content, profiles, events, or groups, such as likes, saves, comments, views, follows, RSVPs, or similar engagement signals.
  • Recency. We may prioritize newer content, recently active users, upcoming events, active groups, recent messages, or recent interactions.
  • Relationship and network signals. We may consider whether users follow each other, are close friends, have mutual connections, have interacted before, share group membership, attended or RSVP’d to similar events, or have similar Platform activity.
  • Subscription or feature availability. Some recommendations or ranking features may be affected by subscription tier, available features, boosts, badges, account status, verification status, or other Platform features.
  • Safety, trust, and compliance signals. We may reduce, restrict, remove, or deprioritize content, profiles, events, groups, or accounts based on reports, blocks, mutes, policy violations, age-verification status, identity-verification status, consent issues, fraud signals, spam signals, moderation status, legal requirements, or safety concerns.
  • Technical and operational signals. We may consider device type, app version, performance, availability, language, region, errors, abuse-prevention signals, or other technical information needed to operate the Platform.

The relative importance of these parameters may vary depending on the feature, user settings, product testing, safety requirements, legal requirements, subscription features, and Platform design.

10. User Options to Modify or Influence Recommendations

Users may be able to modify or influence recommendations through Platform controls, including:

  • updating profile information;
  • changing interests, tags, preferences, or biography information;
  • adjusting location settings;
  • changing radius or nearby-discovery controls;
  • hiding NSFW content;
  • showing NSFW content with or without warnings;
  • blocking users;
  • muting users;
  • hiding posts or content;
  • using keyword filters;
  • following or unfollowing users;
  • joining or leaving groups;
  • saving or unsaving content;
  • RSVPing to or leaving events;
  • using likes, sparks, passes, rewinds, or similar discovery controls;
  • adjusting notification settings;
  • deleting account information; or
  • contacting support about safety, moderation, or recommendation concerns.

Changing these settings may affect what content, users, groups, events, or features are displayed or recommended.

11. Non-Personalized or Less Personalized Options

Where required by applicable law or made available by Platform design, users may have options to view content or results based on less personalized criteria, such as recency, popularity, location, category, search terms, or user-selected filters.

Available options may vary by feature, platform, location, app version, subscription tier, and product design.

If a non-personalized or less personalized option is available for a particular feature, users may select it through the applicable setting, filter, sort, or feature control.

12. Content and Account Visibility

Recommender systems do not guarantee visibility, reach, ranking, matches, followers, messages, event attendance, relationships, dates, sexual activity, subscription outcomes, or any other result.

We may limit, reduce, remove, or restrict visibility for content, profiles, groups, events, or accounts if we determine that doing so is appropriate for safety, legal compliance, moderation, product quality, payment-processor compliance, card-network compliance, app-store compliance, or Platform integrity.

13. Advertising and Sponsored Content

If the Platform displays advertising, sponsored content, paid promotions, boosts, or similar paid visibility features, we may provide disclosures or labels where required by law or Platform policy.

Users must not use paid visibility or promotional tools to promote illegal activity, minors, nonconsensual intimate content, trafficking, exploitation, prostitution, escorting, illegal sexual services, harassment, fraud, or other prohibited conduct.

14. Transparency Reports and EU Recipient Information

Where required by the Digital Services Act, After Dark Society may publish transparency information, including information about content moderation and average monthly active recipients in the European Union.

The scope, timing, and format of any transparency reporting may depend on the Platform’s legal classification, size, user base, available data, and applicable legal requirements.

15. Changes to This Statement

We may update this statement from time to time.

When we make material changes, we may notify users by posting the updated statement, updating the “Last updated” date, sending an email, providing an in-platform notice, using a click-through notice, or using another method reasonably designed to notify affected users.

Your continued use of the Platform after this statement is updated means you acknowledge the updated statement.
