DMCA and Copyright Policy

This DMCA and Copyright Policy explains how After Dark Society, LLC handles copyright complaints, counter-notices, repeat-infringer issues, and related intellectual-property complaints for AfterDarkSociety.com, the AfterDark Society mobile applications, and any related websites, applications, communities, messaging tools, features, and services that link to this policy. In this policy, we refer to those services collectively as the “Platform.”

The Platform is operated by After Dark Society, LLC (“After Dark Society,” “we,” “us,” or “our”).

This policy is part of our Terms of Service and applies in addition to our Community Guidelines, Takedown and Appeals Policy, Nonconsensual Intimate Content Policy, Privacy Policy, and other applicable Platform policies.

1. Copyright Policy

After Dark Society respects intellectual-property rights.

Users must not upload, post, send, store, display, distribute, or otherwise make available content that infringes, misappropriates, or violates another person’s copyright, trademark, publicity rights, privacy rights, or other rights.

Users are responsible for ensuring that they have all rights, licenses, permissions, consents, and releases required for content they upload or otherwise make available through the Platform.

2. DMCA Agent

After Dark Society has designated the following agent to receive notices of claimed copyright infringement under the Digital Millennium Copyright Act:

3. Copyright Infringement Notices

If you believe that content on the Platform infringes your copyright, you may submit a written DMCA notice to our DMCA agent.

Your notice must include:

(1) a physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner;

(2) identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works are covered by one notice, a representative list of those works;

(3) identification of the material claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material;

(4) information reasonably sufficient to permit us to contact you, such as your name, mailing address, telephone number, and email address;

(5) a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner’s agent, or law; and

(6) a statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

4. Incomplete or Defective Notices

If a notice does not substantially comply with the DMCA, we may be unable to process it.

We may request additional information before taking action.

Submitting a notice does not guarantee that we will remove or disable access to the content identified in the notice.

5. Action After Receiving a DMCA Notice

After receiving a valid DMCA notice, we will act expeditiously to remove or disable access to the content identified in the notice.

We may notify the user who uploaded or made available the content and provide the user with a copy of the notice, including the complaining party’s contact information, as permitted or required by law.

We may also take other action under the Terms of Service, Community Guidelines, or other Platform policies, including restricting access to features, disabling uploads, suspending or terminating accounts, preserving records, or taking other action we consider appropriate.

6. DMCA Counter-Notices

If your content was removed or disabled in response to a DMCA notice and you believe the content was removed or disabled by mistake or misidentification, you may submit a written counter-notice to our DMCA agent.

Your counter-notice must include:

(1) your physical or electronic signature;

(2) identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled;

(3) a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;

(4) your name, mailing address, telephone number, and email address; and

(5) a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, to the jurisdiction of the United States District Court for the Southern District of Florida, and that you will accept service of process from the person who submitted the DMCA notice or that person’s agent.

7. Restoration After Counter-Notice

If we receive a valid counter-notice, we will forward it to the person who submitted the original DMCA notice.

Unless the original complaining party notifies us that it has filed an action seeking a court order to restrain the user from engaging in infringing activity, we will restore the removed or disabled content between 10 and 14 business days after we receive the valid counter-notice, unless restoration would violate law, the Terms of Service, Community Guidelines, Nonconsensual Intimate Content Policy, Takedown and Appeals Policy, payment-processor rules, card-network rules, app-store rules, or other Platform requirements.

We may decline to restore content, delay restoration, or take other action if we determine that restoration would violate any of those requirements or create legal, safety, compliance, payment-processing, or platform-integrity risk.

8. Repeat Infringers

We maintain a policy for terminating, in appropriate circumstances, users who repeatedly infringe copyrights or other intellectual-property rights. We will terminate a user’s account when we determine that the user is a repeat infringer under this policy.

In determining whether a user is a repeat infringer, we may consider valid DMCA notices, counter-notices, retractions, court orders, admissions, account history, patterns of infringement, attempts to evade enforcement, and other relevant information. We may disregard notices that are incomplete, abusive, duplicative, unsupported, withdrawn, or otherwise unreliable.

We may also suspend or restrict accounts, remove content, disable access to content, restrict access to features, disable uploads, preserve records, or take other action we consider appropriate to protect rights holders, users, the Platform, and our legal compliance obligations.

We accommodate and do not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as required by applicable law.

9. Misrepresentations

Submitting false, fraudulent, abusive, or bad-faith DMCA notices or counter-notices may expose the sender to liability.

You must not use the DMCA process to harass another person, suppress lawful content in bad faith, interfere with another user’s account, retaliate against another user, or knowingly make false infringement claims.

We may reject abusive notices, reject abusive counter-notices, restrict accounts, terminate accounts, or take other action if we determine that a person has misused the DMCA process.

10. Trademark and Other Intellectual-Property Complaints

This DMCA process applies to copyright complaints.

If you believe content on the Platform violates trademark rights, publicity rights, privacy rights, or other intellectual-property rights, contact us at:

Your complaint should include:

(1) your name and contact information;

(2) identification of the right you claim is being violated;

(3) identification of the content or account at issue;

(4) information reasonably sufficient to permit us to locate the content;

(5) an explanation of why you believe the content violates your rights;

(6) evidence of your ownership or authority to act for the rights holder; and

(7) a statement that the information in your complaint is accurate.

We may request additional information before taking action.

11. Nonconsensual Intimate Content and Depicted-Person Requests

Copyright ownership is separate from consent.

If your complaint involves nonconsensual intimate content, image-based sexual abuse, content depicting you without consent, content involving a minor, trafficking, coercion, exploitation, or other safety concerns, you should also submit a report under the Nonconsensual Intimate Content Policy or Takedown and Appeals Policy.

We may process a complaint under the policy or procedure that best fits the issue, or under multiple policies.

12. No Legal Advice

This policy does not provide legal advice.

If you are unsure whether content infringes your rights or whether you may submit a DMCA notice or counter-notice, you should consult an attorney.

13. Changes to This Policy

We may update this policy from time to time.

When we make material changes, we may notify users by posting the updated policy, updating the “Last updated” date, sending an email, providing an in-platform notice, using a click-through notice, or using another method reasonably designed to notify affected users.

Your continued use of the Platform after an updated policy becomes effective means you acknowledge the updated policy.
