Any individual who appears in any visual depiction of actual or simulated sexually explicit conduct appearing or otherwise contained on AfterDarkSociety.com, the AfterDark Society mobile applications, or any related platform operated by After Dark Society, LLC (collectively, the “Platform”) was at least 18 years old when those visual depictions were produced.
Exemption: Content Uploaded by Third Parties
After Dark Society, LLC is not the “producer,” as that term is used in 18 U.S.C. §§ 2257–2257A and 28 C.F.R. Part 75, of visual depictions of actual or simulated sexually explicit conduct that appear on the Platform solely as a result of actions taken by third-party users of the Platform.
For third-party user-uploaded content, After Dark Society, LLC limits its handling of that content to activities performed in connection with operating the Platform as an online service, including transmission, storage, retrieval, hosting, formatting, review, moderation, restriction, disabling, removal, and other processing of material submitted by third-party users.
All portions of the Platform containing user-generated material are provided as an online service for the relevant user or content provider, and the relevant user or content provider is responsible for complying with 18 U.S.C. §§ 2257–2257A and 28 C.F.R. Part 75 to the extent those laws apply.
After Dark Society, LLC may delete, restrict, disable, remove, moderate, or otherwise act on material appearing on the Platform as a result of actions taken by Platform users if After Dark Society, LLC determines, in its sole discretion, that the material is indecent, obscene, defamatory, unlawful, nonconsensual, exploitative, unsafe, infringing, inconsistent with the Platform’s policies or terms of service, or otherwise objectionable. That moderation activity does not mean that After Dark Society, LLC is the producer of all user-uploaded content.
Exemption: Content Produced by Platform Operator
To the extent that any images or videos appear on the Platform for which After Dark Society, LLC may be considered the “producer,” those images and videos are exempt from the requirements of 18 U.S.C. §§ 2257–2257A and 28 C.F.R. Part 75 to the extent one or more of the following applies:
(1) the images or videos do not portray actual sexually explicit conduct as defined in 18 U.S.C. § 2256;
(2) the images or videos do not portray simulated sexually explicit conduct within the meaning of 18 U.S.C. § 2257A;
(3) the images or videos do not portray the lascivious exhibition of the genitals or pubic area;
(4) the images or videos are otherwise outside the scope of 18 U.S.C. §§ 2257–2257A or 28 C.F.R. Part 75; or
(5) the images or videos are otherwise exempt under applicable law.
Designated Records Custodian
Without limiting the applicability of the exemptions stated above, After Dark Society, LLC has designated the custodian identified below as the keeper of any records maintained by After Dark Society, LLC under 18 U.S.C. §§ 2257–2257A and 28 C.F.R. Part 75 for materials appearing on the Platform that fall into the following categories:
(1) marketing, promotional, or advertising materials that contain visual depictions of actual or simulated sexually explicit conduct, that were acquired, created, commissioned, or produced by After Dark Society, LLC to promote the Platform, and that are not otherwise exempt; and
(2) any other materials for which After Dark Society, LLC is required by applicable law to maintain records.
